ACTIVE NETBALL – TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern:

• Your use of the Active Netball website (“Website”); and
• Your attendance at and/or participation in any Active Netball league, match, tournament, training session, community session (including “rock up” sessions), workshop, course, trial, private event, promotional event, or any other activity organised or delivered by Active Netball (collectively referred to as the “Activities”).

By using the Website and/or attending and/or participating in any Activities, you agree to be bound by these Terms.

1. Governing Law and Jurisdiction
   • These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates.
   • The courts of Dubai shall have exclusive jurisdiction to resolve any dispute arising in connection with these Terms.
   • The United Arab Emirates is our country of domicile.

2. Eligibility and Registration

• You must be at least 18 years old to register on the Website or make payments.
• Participants under the age of 18 must be registered by a parent or legal guardian, who agrees to these Terms on the minor’s behalf.
• Parents and guardians are solely responsible for:
  • Providing accurate registration information;
  • Ensuring their child is registered in the correct age group and competition category; and
  • Ensuring their child is medically fit to participate.
• Active Netball reserves the right to reassign participants to the appropriate age group or restrict participation where incorrect information has been provided.

3. League Rules and Additional Regulations

• In addition to these Terms and Conditions, separate league rules, competition regulations, codes of conduct, safeguarding policies, and event-specific guidelines may apply to particular leagues, divisions, tournaments, community sessions, or Activities (the “League Rules”).
• All participants, parents, guardians, coaches, officials, volunteers, and spectators agree to comply with any applicable League Rules.
• Where League Rules apply:
  • They form part of these Terms;
  • They are binding on all participants;
  • They must be read together with these Terms.
• Failure to comply with League Rules may result in disciplinary action, including suspension, removal from Activities, or termination of participation.

4. Participation and Assumption of Risk

• Participation in sporting activities involves inherent physical risks, including the risk of injury.
• By participating in any Activities, participants:
  • Confirm they are medically fit to participate;
  • Accept that participation is voluntary;
  • Acknowledge and assume the inherent risks associated with netball and related activities.
• Nothing in these Terms excludes liability where exclusion is not permitted under UAE law.

5. Good Sportsmanship and Conduct

• Active Netball promotes respect, inclusivity, and positive community values.
• All players, coaches, officials, volunteers, and spectators must:
  • Demonstrate good sportsmanship at all times;
  • Treat others with respect and fairness;
  • Follow league rules and instructions from officials;
  • Comply with all applicable UAE laws.
• Abusive behaviour, unsafe play, harassment, discrimination, intimidation, or unsporting conduct will not be tolerated.
• Active Netball reserves the right to remove, suspend, or permanently ban any individual for misconduct or breach of these Terms or League Rules.

6. Safeguarding and Child Protection

• Active Netball is committed to providing a safe and inclusive environment for children and vulnerable participants.
• All adults interacting with minors during Activities are expected to:
  • Behave appropriately and responsibly;
  • Avoid conduct that may place a child at risk;
  • Comply with safeguarding standards implemented by Active Netball.
• Parents and guardians remain responsible for the supervision of their children.
• Active Netball reserves the right to take immediate action, including removal from Activities, where safeguarding concerns arise.

7. Payments

• If you make payment for league registration, community sessions, events, merchandise, or other services:
  • Payment details are submitted directly to our authorised third-party payment provider via a secure and encrypted connection;
  • Active Netball does not store full credit or debit card details;
  • Transactions are subject to verification and approval by the payment provider.
• The cardholder must retain copies of transaction records and review merchant policies and rules.
• Active Netball reserves the right to refuse or cancel transactions in cases of suspected fraud, payment failure, or breach of these Terms.

8. Refunds and Cancellations

• All registration fees, event fees, and session payments are non-refundable unless otherwise stated.
• Refunds are strictly subject to review and approval at the sole discretion of Active Netball.
• If approved, refunds will be processed to the original payment method.
• Active Netball reserves the right to reschedule, relocate, modify, or cancel Activities due to weather conditions, venue issues, safety concerns, insufficient registrations, government directives, or circumstances beyond its reasonable control.
• Nothing in this clause limits rights under applicable UAE Consumer Protection legislation.

9. Media, Photography and Recording

• By attending or participating in any Active Netball league, match, community session, training, tournament, or event, all players, coaches, officials, volunteers, and spectators acknowledge and agree that photographs and video recordings may be taken.
• Active Netball may use such images and recordings for league, marketing, promotional, and community purposes, including but not limited to:
  • Social media platforms;
  • Official websites;
  • Digital publications;
  • Print materials;
  • Promotional campaigns and communications.
• Such use will reflect the positive spirit, inclusivity, and community values of the league.
• Where a participant is under 18 years old, a parent or legal guardian provides consent to photography and recording upon registration.
• Any individual who does not wish to be photographed or recorded must notify Active Netball in writing prior to the relevant Activity. While reasonable efforts will be made to accommodate such requests, exclusion from all group images or event footage cannot be guaranteed.

10. Intellectual Property

• All Website content, branding, logos, materials, league documentation, and media produced by Active Netball remain its property and are protected under UAE intellectual property laws.
• No content may be copied, reproduced, or used without prior written consent.

11. Website Use

• You agree to use the Website lawfully and in accordance with UAE laws and regulations.
• You must not:
  • Attempt unauthorised access;
  • Introduce malicious software;
  • Use the Website for unlawful or fraudulent purposes;
  • Interfere with Website functionality.
• Active Netball may suspend or terminate Website access for breaches of these Terms.

12. General

• To the maximum extent permitted under UAE law:
  • Active Netball shall not be liable for indirect, incidental, or consequential losses arising from participation in Activities or use of the Website;
  • Active Netball is not responsible for loss, theft, or damage to personal belongings brought to Activities.
• Participants agree to indemnify and hold harmless Active Netball, its organisers, volunteers, coaches, officials, and representatives against claims, liabilities, damages, or expenses arising from:
  • Their breach of these Terms;
  • Their misconduct;
  • Their violation of applicable laws.
• Active Netball shall not be liable for failure or delay in performing obligations due to events beyond its reasonable control, including but not limited to weather conditions, venue closures, government restrictions, public health events, or other unforeseen circumstances.
• Active Netball reserves the right to amend these Terms at any time. Updated Terms take effect upon publication on the Website.

15. Acceptance of Terms

• By ticking the acceptance box during registration, payment, or event sign-up, you confirm that:
  • You have read, understood, and agree to be legally bound by these Terms and Conditions;
  • You agree to comply with any applicable League Rules and policies;
  • If registering a minor, you are the parent or legal guardian of the participant and you consent to these Terms on their behalf;
  • You consent to participation in the Activities in accordance with these Terms;
  • You acknowledge the participation risks outlined in these Terms;
  • You consent to photography and media use as described above.

Electronic acceptance of these Terms shall constitute a legally binding agreement between you and Active Netball under applicable UAE laws
